California rock band KYUSS LIVES! - featuring original KYUSS members John Garcia, Nick Oliveri and Brant Bjork along with guitarist Bruno Fevery - has issued a statement in response to the lawsuit filed by former band member Josh Homme over the use of the Kyuss name.

"We are both shocked and saddened that our friend and one time band mate has chosen to file a lawsuit against us, especially after having positive discussions since our reformation," said John Garcia and Brant Bjork. "We look forward to resolving this private matter behind closed doors and moving forward with work on our new album and connecting with our amazing, loyal fans."

Kyuss Lives! recently entered Thunder Underground Studios in Palm Springs, CA to begin work on a live album. The band released the following:

“We are in the studio mixing the Live record. Harper Hug is the studio man! See the Euro folks in a few months for a month long tour. Looking forward to it!”
