Two Riverside Men Taking Ozzfest Organizers To Court For Injuries Sustained During 2007

Two Riverside County men who contend poor security was to blame for injuries they suffered at the 2007 Ozzfest concert can take their case to trial next year, a Los Angeles judge said today.
Superior Court Joseph Kalin issued a ruling Thursday denying defense motions to dismiss the negligence/premises liability complaint brought by concertgoers Michael McClelland and Stephen Holloway, although he did not allow them to take all of their claims to trial.
During a brief hearing today, Kalin scheduled trial for April 19.
The defendants are Contemporary Services Corp. of Northridge, which provided security at the July 21, 2007, event; Live Nation Worldwide Inc., which promoted the concert, and Pavilion Partners Ltd., owners of Glen Helen Pavilion in Devore.
Kalin said the negligent hiring claims against Contemporary Services will stand, but he dismissed the same claims against Live Nation and Pavilion Partners because they were not involved in hiring the security guards.
The judge also said he was dismissing the claims for punitive damages for now, but that lawyers for the plaintiffs can state a case for reinstating them during the trial.
