Defence Lawyers Want Charges Thrown Out In "Edmonton Metal Fan Dies Over Argument About METALLICA" Case

Defence lawyers want a judge to throw out charges against four teens charged with killing a man on an ETS-bus last March.

This ends a preliminary hearing that began last month, to determine if four teens should go to trial for their part in the death of 35-year-old Stephan Conley.

Conley died on the 2nd of March last year after he got into a dust-up with a group of teens, following an argument about the rock group, METALLICA.

Witnesses said that Conley grabbed one of the boys, and the other three jumped him, punching him repeatedly.

Crown prosecutor Wade Marke had his final argument Thursday.

Friday the four defence lawyers had their turn. One by one, they called for a discharge. That means charges should be tossed.

Laura Stevens pointed out it was a drunk Stephan Conley who started the fight by assaulting one of the boys. She said the boys stopped what they were doing as soon as Conley stopped what he was doing.

Stevens pointed out Conley died – not from a vicious attack – but from a freak accident, when a major artery at the base of his skull broke, when he was pushed back on the seat.

Peter Royal said the evidence that came up at the hearing is not the same story as was pitched in the media. He said there was nothing to media reports that Conley was stomped on or swarmed.

The judge says he’ll rule on February 2nd.
